Dog Fouling


For some considerable time, dog fouling has been a problem on the children’s enclosed play area in the centre of Newchurch. However, over the past few months many residents have made complaints over the increasing amount of fouling which has discouraged them from taking children into the area. 

Due to this ongoing problem, the Parish Council has contacted Pendle Borough Council to seek ways to prevent the nuisance by exercising their power under section 59 of the Anti-Social Behaviour, Crime and Policing Act 2014 and the Public Spaces Protection Order No1 2019, (PSPO). This would mean a total ban on dogs entering the children’s play area and in addition, would include a smoking ban in the same area, (this is part of the order and non negotiable). 

To allow the Parish Council to proceed, there must be a public notice of its intention and a period of consultation for two weeks. This has now taken place. The order, if agreed will be enforceable by law in the way of fixed penalties and will be issued by either a Police Constable, a Police Community Support Officer or a person authorised by the Borough Council. 

At present this does not include the lower playing field or the wooden adventure park but this will be assessed at a later date.
